Managing Ethical & Legal Risks for Counselors
1. Goals: By the end of this workshop, attendees, through presentation and case examples, will be able to:
A. Identify and discuss the top ten highest-risk areas for ethical complaints against counselors.
B. Identify which ethical violations most often lead to Licensing Board investigations and sanctions (Regulatory Law).
C. Identify which ethical violations most commonly result in the filing of malpractice lawsuits (Civil Law).
D. Learn which ethical violations can lead to Criminal Law Charges.
E. Develop an outline of practice tips to help reduce risks of complaint, whether legal or ethical.
Presenters
Dr. Jon Sward is both a Licensed Clinical Professional Counselor and an attorney. He served as the CEO of the CMHC in Concordia, KS. He has worked as a clinician in several CMHCs, at the Larned Juvenile Correctional Facility, and worked at Fort Riley as a Military Family Life Counselor. He has over thirty-five years of experience in private practice work. Dr. Sward served as an Assistant Professor of Mental Health Counseling and later was a Clinical Instructor and Interim Director of the Community Counseling Center at Emporia State University. In the 80s, Dr. Sward was a member of the KCA group that investigated and recommended licensure for professional counselors to the Kansas State Legislature.
Dr. Basil Kessler is an Associate Professor and the Director of Clinical Counseling for Emporia State University. He has worked in the field of disability services for over 40 years, specializing in mental health services for DHH individuals and their families. He has served on the KCA Executive Board since 2019 and is the current KACES President. He has served on numerous state-level boards and working committees, including the KDADS Behavioral Health Integration into Schools (BHIS) Program and the KDHE STEPS Pilot Program. A CMS Pilot Study for the Employment of Kansans with SPMI Needing Attendant Care Services at Work, and the KS Commission for the DHH. His most recent publication is Adult Child Estrangement: Clinical Considerations for Deaf Clients.
